James Wibberley was called to the Bar in 2009.
He was awarded major scholarships from Lincoln’s Inn for the CPE and BVC years. He was awarded the Taylor Prize for the best overall performance on the Bar Vocational Course at Nottingham Law School and the BVC Advocacy Prize for receiving the highest score for the advocacy component of the course.
He has a general civil law practice and is a member of all Special Interest Groups within Chambers.
Personal Injury
He has a particular interest in the personal injury field, acting for both Claimants and Defendants at all levels within the County Court.
James is regularly instructed on a range of personal injury matters including road traffic accidents, employers’ liability, public liability, highways and defective premises claims. He also has experience of dealing with claims for defective products and negligent beauty treatments.
In addition to his court work, James has a busy paperwork practice, drafting statements of case and advising upon issues of liability, tactics and quantum.
James is happy to accept instructions on a CFA basis.
Clinical Negligence
As part of his personal injury practice, James has acted in a number of clinical negligence disputes. He is keen to build this area of his practice.
Fraudulent Claims
An increasing proportion of his practice is within the field of fraudulent claims, where he appears at both interim hearings and trial. He has a particular interest in the arguments surrounding ‘low velocity impact’ and in claims involving staged accidents, exaggerated symptoms and/or phantom passengers.
Costs
James has a particular interest in the field of costs, and regularly advises upon matters surrounding Part 36, and disputes following settlement. This area overlaps with James’ interest in contractual disputes, and he has experience of advising upon the validity (or otherwise) of compromise agreements.
He is an active member of the Costs Specialist Interest Group within Chambers and a contributor to the Ropewalk Chambers Costs ejournal.
Business and Property
James undertakes a range of commercial work, ranging from possession and housing matters in the county court, to insolvency matters in the RCJ. He has been involved in consumer credit cases for both creditors and debtors and has an interest in claims brought under the Financial Services and Markets Act 2000.
James is regularly instructed in commercial disputes at all levels within the county court, dealing with claims breach of contract, failure of consideration and restitution. He acts for Claimants and Defendants alike.
He also has experience of property disputes involving issues of trespass and nuisance, and where the remedies sought include both injunctions and declaratory relief.
James has a particular specialism in the field of credit hire, and is regularly instructed in relation to issues of enforceability under the Consumer Credit Act 1974 and the Cancellation of Contracts made in a Consumer’s Home or Place of Work etc Regulations 2008. He also has an interest in arguments relating to the issue of illegality and to what extent courtesy car provision should be considered when addressing the mitigation of loss.
Employment
James has represented both Claimants and Respondents at employments tribunal proceedings and on matters ranging from limitation/jurisdiction disputes, to claims for redundancy payments.
Planning
James has a strong interest in planning law, and is keen to build this area of his practice.
Local Government
James regularly acts for local authorities on housing matters, and has recently acted for a local authority in the successful defence of a section 204 homelessness appeal.
He is happy to accept instructions from both Claimants and Defendants on matters of public law and claims for judicial review.
General
Away from the Bar, his interests include running, swimming and triathlon.
