Kam Jaspal was called to the Bar in 2005.
He was appointed to the Attorney General’s Regional Panel of Counsel to the Crown in 2010.
He regularly appears in the County and High Courts and has also appeared in the Court of Appeal. In addition, he has acted as an Examiner of the Court (on appointment by the Senior Master) in a matter where deposition evidence was required by a foreign jurisdiction.
He has an interest in all areas of work serviced by Chambers’ Special Interest Groups.
Business and Property
Kam has a particular interest in commercial litigation and is regularly instructed in contractual disputes, agency claims (including payments of commissions to sports agents) sale of goods matters, consumer credit claims, insurance litigation, insolvency and bankruptcy claims, company law matters, professional negligence claims and contentious probate matters.
He was Counsel for Welcome Financial Services in Welcome Financial Services Ltd v Nine Regions Ltd (t/a Log Book Loans) [2010] 2 Lloyd‘s Rep 426. He also appeared for Welcome Finance in the Court of Appeal in 2011.
In addition to drafting and advisory work, Kam has acted in a number of consumer credit trials including a significant group action arising from the sale of payment protection insurance policies.
He regularly appears in the Mercantile, Commercial and Chancery Divisions of the High Court.
Personal Injury
He acts for both Claimants and Defendants in all aspects of personal injury work, including employers’ liability, public liability, tripping and slipping claims, occupiers’ liability, defective premises and road traffic claims.
In addition to appearing in the County and High Courts, he appears at CICA hearings and Coroner’s Inquests.
Kam has been led by Dominic Nolan Q.C. in some catastrophic personal injury claims.
Clinical Negligence
He has represented parties in claims for clinical negligence including claims arising from delay in diagnosis, misdiagnosis and negligent treatment.
Disease
He is instructed in industrial disease claims arising from exposure to asbestos and other respiratory diseases, HAVS, RSI claims, noise induced hearing loss and COSHH cases.
He was instructed as Junior Counsel in a high value case arising from exposure to Benzene on an oil rig.
Fraudulent Claims
He conducts work in all manner of claims that include a fraudulent or exaggerated element with a particular emphasis on fraudulent insurance claims and matters of material non-disclosure and misrepresentation.
He also has considerable experience in ‘low velocity impact’ claims and claims arising from staged accidents.
Regulatory
Kam’s practice entails advocacy and advisory work in relation to the statutory frameworks that govern health and safety in the work place, including the ‘Six Pack’ Regulations.
Costs
He has an interest in costs and has represented parties in a number of contested hearings and applications relating to the recoverability of costs, including recoverability of success fees and insurance premiums in claims funded by way of Conditional Fee Agreements.
He regularly appears at detailed assessment hearings.
Employment
He has represented parties at Employment Tribunals in a range of cases dealing with discrimination, unfair, wrongful and constructive dismissal.
Planning and Environmental
Kam has advised and represented local authorities in private prosecutions for environmental offences including fly tipping. He has also been instructed by the Environment Agency.
He has advised in relation to enforcement notices and has an interest in planning appeals.
Local Government
Kam has a particular interest in housing law and sits on the board of a midlands based housing association. He regularly represents landlords and tenants/occupiers at multi-track level in possession and demotion claims, disrepair claims and claims arising from anti-social behaviour.
He regularly represents parties at committal hearings.
General
Interests away from the Bar include rugby, football, squash, skiing and pool.
