Kate Herbert was called to the Bar in 2004.

She has a general civil practice but is particularly interested in personal injury, fraudulent claims, housing, employment, clinical negligence and costs.

Personal Injury

She has particular experience and interest in personal injury, acting for both claimants and defendants.  She has particular experience of road traffic accidents, accidents at work dealing with the health and safety regulations, highways claims, occupiers’ liability and holiday claims.

She also has experience in the Coroners Court, of CICA claims and CRU appeals.

She has a busy paper work practice advising and pleading on all of the above areas of work and on all tracks.

Clinical Negligence

She has settled pleadings and attended interim applications and CMC’s in clinical negligence cases and is keen to develop this area of her practice.

Disease

She has experience of settling pleadings in industrial disease claims for all parties.  This includes Hand Arm Vibration Syndrome, Noise Induced Hearing Loss, and asbestos related claims.

She has acted at the case management stages dealing with a range of issues.

Fraudulent Claims

She has experience of all manner of fraudulent claims in the personal injury field, particularly road traffic accidents.

This experience includes settling pleadings, advising, interim applications/CMC’s and trials.

Housing

She has a particular interest in housing.  She has experience in dealing with possession claims arising out of anti-social behaviour and other breaches of tenancy, acting for both claimants and defendants.  She has also undertaken a number of committal hearings.

Costs

She has appeared for parties in costs applications and detailed assessment proceedings at interim and final stages.

Kate accepts instructions under Conditional Fee Agreements.

Employment

She has experience of advising and conducting trials on employment matters including unfair dismissal, discrimination and redundancy.

She deals with pre-hearing issues in the employment field for both applicants and respondents.

General

Interests away from the Bar include travel, attending the gym, cycling, walking, skiing, film and theatre. Kate loves animals and has her own marine aquarium.  She is learning to Scuba dive.  One ambition is to learn to fly a helicopter.
