Shilpa Shah was called to the Bar in 1998.

She attended BPP Bar School where she won First Prize for Advocacy and gained a final overall mark which put her within the top ten highest achievers of that year.

Prior to that she had completed a Masters’ Degree in Law, in which she achieved a Distinction (equivalent to First Class).

She is a member of Lincoln’s Inn, where she won the Gluckstein Prize for Advocacy and won a Major Scholarship.

During her early years she worked with the Free Representation Unit and for the Citizens Advice Bureau.

She practices within civil work generally, with a particular specialism in cases involving allegations of fraud.

Her practice specialises in all aspects of personal injury, clinical negligence, professional liability, disease, regulatory, costs, business and property, insolvency and local government claims.

Fraudulent Claims

Her practice and experience in fraudulent claims has grown substantially over the past years and she is now regularly instructed in all aspects of cases in which fraud is an issue.

In particular, she is often instructed to advise at an early stage in the collation of evidence, in meeting with witnesses and experts in conference, drafting, attending applications and conducting trials involving allegations of fraud.

Her practice encompasses all aspects of fraud in personal injury matters, including road traffic accidents, employers’ liability, local authority cases and insurance as well as claims directly against individuals.

Her work includes aspects of fraud in insolvency and bankruptcy and advising on tracing remedies.

Personal Injury

She undertakes every aspect of a personal injury claim, dealing with all types of injuries and assessment of losses including fractures, whiplash, scarring and psychiatric injuries; calculations and advising as to special damages calculations; assessing and advising as to general damages valuation; road accident claims (including low velocity impact incidents) and multiple party claims; claims either against or defending Local Authorities, employers’ liability regulations; occupiers’ liability; sporting liability; Animals Act cases and negligence generally.

She is instructed in Fatal Accident claims and in claims involving arguments of Secondary Victims.

She is experienced in cases involving children and protected parties unable to act without assistance and in advising in respect of Mental Capacity issues. 

She acts for Claimants and Defendants in broadly equal measures at trials and all types of interim matters, assessment of damages and costs hearings.

She is regularly involved in other related matters, including attendances at inquests, large value approval hearings for protected parties, CICA and CRU Appeals.

She has a busy paperwork practice which includes settling pleadings and advising at all levels and at various stages of the litigation process.

Clinical Negligence

She has experience in a range of clinical negligence matters, from involvement at interim levels, including advocacy at applications and case management conferences to group actions.

Disease

She has represented parties in numerous disease cases.  She has been instructed in interim matters and at hearings on the preliminary issue of limitation and assessments of damages hearings.

Her experience includes appearing as trial Counsel in a range of diseases claims and attending at Inquests involving mesothelioma and asbestos exposure.

Regulatory

Regulatory matters in which she works include Health and Safety, Buildings Regulations, trading standards and licensing.

Costs

She is experienced at all levels of costs work including summary assessments and detailed assessment hearings, with arguments on principles and quantification.

Business and Property

Other civil law work includes contract, insolvency and personal bankruptcy, land law (including housing, property, disrepair, possession and trespass), company and commercial matters, consumer credit and consumer regulations.

She has advised in claims involving various contractual disputes and conducted trials involving issues of breach of contract.

Local Government

She conducts work in actions brought against Local Authorities, drafting and representation at hearings in obtaining and enforcing Anti-Social Behaviour Orders, education matters, housing and injunctions generally.
