Fraudulent Claims
For many years, we have acted for Defendants in claims involving suspected exaggeration or fraud, both in regard to injury and alleged financial losses. The volume of such cases is increasing all the time, particularly in relation to suspected fraudulent road traffic accidents, where issues of liability as well as more traditional quantum disputes are now to the fore.
Leading and junior members are noted for their defence work in chronic pain cases, fibromyalgia claims, back injury and cases of alleged or suspected malingering and illness deception behaviour.
There is strength in depth within Chambers for dealing with cases regarding suspected fraudulent motor claims including phantom passengers; switched drivers; fictitious accidents; staged accidents; grossly exaggerated injuries out of proportion to the extent of the impact; low velocity impact claims; exaggerated special damages; disproportionate hire and storage claims; all aspects of MIB defence work and defences of illegality. Members are also experienced in defending claims where organised, or ringed, fraud is suspected.
Commercial litigation specialists within Chambers frequently deal with claims turning on the effects of exaggeration in claims made under insurance policies and complex commercial litigation concerning fraudulent dealings and insurance agents. We have experience of large cases concerning employee fraud, conspiracy, theft and forgery. Members have been instructed on issues of receivership and insolvency; asset tracing and civil recovery; the obtaining of freezing orders and related injunctions; and all relevant aspects of High Court practice and procedure, including the securing of computer records.
