Appeal Proceedings in High Court Public Liability Case

Ed recently represented a private company in appeal proceedings in the High Court (Birmingham District Registry). This was a Public liability claim where the claimant sought compensation for injuries sustained in the facilities of the private company when she walked into an electrical cable which was dangling from the ceiling.
The judge at first instance held that the accident was not foreseeable and the claim failed. Issue on appeal was whether this was a foreseeable accident and the High Court judge agreed with the submission of the private company that “although a different mind on a different day may have reached a different decision”, the decision at first instance could not be said to have been wrong.
