Ivan Cartwright

Ivan has more than twenty years extensive experience and the majority of his work is in medium to high value, including fatal and life-changing, injury claims. He is known by his instructing solicitors to be approachable and always to provide clear and practical advice.

He is an Assistant Coroner for Nottinghamshire, appointed in April 2013. He has been conducting Inquests regularly since July 2013, with a special interest in prison / custodial deaths.

He has, in the recent past, been a member of the Attorney General’s Panel of Counsel, having provided advice and representation in litigation brought against various Government Departments and Agencies.

He is registered with the Bar Council to undertake direct access work and is able to receive instructions directly from lay clients, as well as those on the traditional professional client basis.

Ivan has lived in Nottingham since 2006, is married to a GP who practices locally and has two young sons. When not working Ivan’s interests include travel, politics (as an impartial observer) music, film, playing racquet sports and trying to keep pace with his sons.

Personal Injury

Ivan advises and represents equally for Claimants and Defendants (for all major insurer clients) across a wide variety of claims in all parts of the country.

He has more than twenty years’ experience of assisting with employers’ liability, public liability, road traffic and highway claims as well as the liability of occupiers and landlords.

Recent cases undertaken have included negotiating pre-trial settlement on behalf of an ex-mining worker claiming whole life earnings and consequential losses as a result of a complex upper limb injury sustained during an accident underground; successfully defending a national company providing work equipment for hire, at a multi-track, liability only trial, following a claim made by a skilled worker who fell from mobile scaffolding and suffered permanent and serious injury; maintaining the Claimant’s best position at Joint Settlement Meeting and agreeing a total sum, for injury damages and other losses, which bettered the Claimant’s last offer and exceeded £0.5m; and the defence of a claim brought by a trespasser, who had scaled a wall and entered a rear yard area, against the occupier who had retained and negligently stored a number of hazardous substances.

Disease

In line with Chambers’ strengths and experience in dealing very regularly with a wide range of claims relating to occupational disease, Ivan has an established practice and recent experience in noise-induced hearing loss claim. He has represented both Claimants and Defendants at numerous trials where breach of duty, causation and limitation are in issue and involving limitation, taken as a preliminary issue, including cases where expert witnesses are cross-examined. He has represented at numerous interlocutory hearings, CCMC;s and allocation hearings where the need for expert evidence is sought, or countered, and where appropriate case track is in contention;

He is experienced in asbestos-exposure cases and has advised and represented in cases where causation and liability are in issue with complex quantum calculations. He has also represented the Defendant in High Court pleural thickening trials, negotiating settlement in a number of high value mesothelioma and lung cancer claims and has experience of ‘Show Cause’ hearings.

He has advised and represented in hand-arm vibration syndrome cases where breach and / or causation are contested, for example in disputes as to the origin / occurrence of (constitutional or occupational) carpal tunnel syndrome.

Ivan has advised in claims brought by persons alleging injuries as a result of work-related contact and irritant dermatitis, exacerbation of asthma and other chest and lung conditions.

Clinical Negligence

Ivan has provided advice on case management and trial preparation in a number of cases including incorrect or late diagnosis and negligently performed surgery, including plastic surgery and in dental cases.

He has advised members of the nursing profession and other professional carers, as well as clinicians and Claimants.

Employment

Ivan’s time working in employment law, as a proportion of his practice, reduced between 2013 and 2017, but he continues to advise and represent Claimants and Respondents, including businesses of all sectors and sizes, across a broad range of employment law issues.

He has been involved in two and three week long hearings, involving complex issues of both fact and law.

In recent years his work has included discrimination claims relating to sex, race, age and disability, unfair dismissal and redundancy matters, victimisation and harassment by employer and fellow employees, ‘whistle blowing’ cases (including a claim recently settled shortly prior to final hearing for close to £50,000), contractual disputes (including the interpretation of restrictive practice) equal pay matters.

Inquests

He intermittently represents the interests of companies and individuals in the Coroners’ Court and has a special interest in deaths in custody, especially prison deaths, albeit he has also attended hearings into deaths following workplace, road traffic and medical accidents.

He represented the family of a man with mental health problems, fatally shot by police officers on Merseyside, during a three week inquest with Coroner and jury.

Criminal Regulatory

Ivan has, in the past, represented companies and individuals prosecuted by the Health and Safety Executive and by the Environment Agency (for example, water pollution).

He has also represented, at Tribunal over a three day hearing, a company’s appeal of an Environment Agency enforcement notice, following an accident at the company’s factory premises.

When the scheme was initially introduced, he was regularly involved in appeals against the imposition of Civil Penalties, following businesses’ alleged engagement of illegal migrant workers and in appeals by employers relating to National Minimum Wage legislation enforcement.

Costs & Litigation Funding

Ivan has experience of cost budgeting across his areas of practice. He has also represented both paying and receiving parties in a number of detailed assessments, including full day hearings against specialist Counsel and at appeal hearings.

Housing

Ivan advises and represents local authorities, housing associations and individuals across a broad range of housing work, including possession, demotion, licensing and management under the Housing Acts, disrepair, unlawful eviction, anti-social behaviour and neighbour nuisance.

He has represented local authorities and individuals in appeals against allocation decisions around homelessness and in ‘nuisance neighbour’ cases.
