Sarah Hopkinson

Call: 2013

Sarah studied law at the University of Sheffield where she won the university’s mooting competition in her first semester and went on to graduate with a 2:1 degree. She spent one of her four undergraduate years at Griffith University in Australia, for which she obtained a High Distinction.

Sarah completed the BPTC at Nottingham Law School, achieving a grade of Outstanding, for which she received the Buchanan Prize from Lincoln’s Inn. She was also awarded the Taylor Price by Nottingham Law School for obtaining the highest overall marks in her year.

Away from the Bar, Sarah enjoys travel and eating out, the latter perhaps arising from a lack a culinary interest, or skill.

Personal Injury

Personal injury is Sarah’s main practice area, in which she accepts instructions from Claimants and Defendants.

She regularly attends trials, applications and other interlocutory hearings in a broad range of EL and PL matters. In addition, Sarah accepts instructions to draft pleadings and advise in conference or in writing, with personal injury related matters forming the bulk of her paperwork practice.

Sarah also has experience of Coronial work.

Counter Fraud

Sarah is regularly instructed on behalf of Defendants in allegedly fraudulent RTA matters, and is well versed in the usual defences including LVI, phantom passengers and staged accidents.

Costs & Litigation Funding

Sarah regularly appears at CCMC’s to both attack and defend budgets. She frequently conducts summary assessments and is well-practiced in submissions concerning unreasonable conduct, the disapplication of QOCSs and costs consequences relating to part 36.

Sarah appeared for the Appellant in an appeal to the High Court on whether it was unjust to apply part 36 cost consequences and whether exceptional circumstances existed so as to warrant additional costs pursuant to CPR 45.29J. Sarah is keen to further develop this area of her practice.

Disease

Sarah is experienced in noise-induced hearing loss matters and is regularly involved in cases for both Claimants and Defendants on the Fast and Multi Tracks. In addition to appearing in Court, Sarah frequently drafts pleadings, advises and conducts conferences in such matters.

Credit Hire

Sarah routinely appears for Claimants and Defendants on the Small Claims and Fast-Tracks in credit hire claims. She prides herself on keeping up to date with the latest credit hire decisions and arguments and has plenty of experience running arguments relating to need, period, enforceability and rate of hire.

Motor

Sarah is routinely involved in road traffic accident trials for Claimants and Defendants. She is experienced in RTA-related disputes relating to liability, credit hire and counter fraud.
