Ropewalk - Law firm

Thomas Herbert

Call: 2014

Tom studied Chemistry at the University of York and graduated with a Master’s degree before studying the Graduate Diploma in Law and Bar Professional Training Course at Nottingham Law School. He was graded “Outstanding” on the BPTC and obtained the highest mark in his year in Civil Litigation.

While at Law School, he was also a successful mooter: He won the annual Inter-Inn moot for the Inner Temple, came second in the Ropewalk Chambers mooting competition and won the Nottingham Law School / Kaplan Law School varsity moot, which was judged by Lord Carnwath at the Supreme Court.

Tom has a broad civil practice. He deals with personal injury and industrial disease cases across all tracks, including advice on procedure and tactics. He also deals with, and has a particular interest in, property, commercial and local government matters (including education law). He is well-versed in the law relating to credit hire.

As a result of his scientific background, he has a rigorous, analytical approach. He particularly relishes cases involving abstract or technical points of law, and is adept at dealing with engineering issues and complex calculations.

Having completed his pupillage under the supervision of Andrew Hogan, Tom has a particular interest in costs litigation. He assisted with legal research in a number of high-profile decisions such as Jones v Spire Healthcare Ltd (assignment of conditional fee agreements) and Essar Oilfields Services Ltd v Norscot Rig Management PVT Ltd [2016] EWHC 2361 (Comm) (costs awards in arbitration proceedings).

In his own right, he has attended numerous CCMCs, for both Claimants and Defendants, as well as detailed assessment hearings (including preliminary issue hearings and oral reviews). He is currently instructed on an appeal concerning the recoverability of an ATE insurance premium in clinical negligence proceedings.

As a result of his time working as a paralegal in a firm of family law solicitors prior to pupillage, Tom also has a special interest in claims relating to beneficial interests in property (constructive trusts and proprietary estoppel). He has appeared at the final hearing of a claim under the Trusts of Land and Appointment of Trustees Act 1996.

Other examples of recent work include:

  • representing the deceased’s family at a four-day jury inquest following a workplace accident;
  • advising in relation to contribution proceedings against a manufacturer following settlement of a personal injury claim;
  • advising and settling pleadings in a multi-track construction dispute;
  • advising on a technical point as to the application of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013;
  • representing the judgment creditor in enforcement proceedings in the High Court; and
  • advising a local authority in relation to special educational needs proceedings.

Away from the Bar, Tom’s interests include current affairs, food, spending time with family and friends and hiking. For a number of years he has volunteered at a local primary school, where he is now a school governor.
