Damian Powell

Damian joined Ropewalk Chambers in 2018. Prior to that he was in chambers in London for almost 15 years, where he practised predominantly in personal injury work.

Damian’s practice incorporates all aspects of Chambers’ personal injury and clinical negligence work. He is also ranked in the Legal 500 as a leading junior for police law (defendant).

For many years Damian undertook serious criminal work in the Crown Court and Court of Appeal, including fraud cases. This experience has honed his trial advocacy and cross-examination skills. It gives him a particular advantage when acting in personal injury trials where fraud is alleged.

Damian prides himself on being very approachable to both his lay and professional clients and is committed to delivering an excellent service to each of them by supplying prompt, incisive paperwork as well as providing tenacious and fearless representation at court.

Damian’s interests away from the Bar include rugby, football, skiing and spending time with his family.

Personal Injury

Damian acts for and advises both Claimants and Defendants in a wide range of personal injury claims, including: cases involving fatal accidents, employers’ liability claims, claims arising from defective premises, public liability claims, claims under the Highways Act 1980, occupiers’ liability claims and road traffic accidents.

Over the years, Damian has represented parties in the above types of claim at many coroners’ inquests, costs and case management conferences, applications, joint settlement meetings and, of course, trials.

Damian has considerable experience in advising (both in writing and in conference) and settling pleadings in the above types of claim in both multi-track and fast track cases.

Counter Fraud

For many years Damian undertook serious criminal work in the Crown Court and Court of Appeal, including fraud cases. This experience has honed his trial advocacy and cross-examination skills. It gives him a particular advantage when acting in personal injury trials where fraud is alleged.

He recently secured a finding of fundamental dishonesty against a Claimant and, the Court also being satisfied the Claimant would not suffer substantial injustice, an order that the entirety of the claim be dismissed and that the Claimant lose his QOCS protection.

Disease

Damian practises in disease work. He has particular experience in mesothelioma claims, having been regularly instructed by the legal department of one of London’s emergency services to deal with such claims on its behalf.

Clinical Negligence

Damian represents both Claimants and Defendants in a wide range of clinical negligence claims involving NHS Trusts, GPs and dentists.

He has appeared on behalf of families at coroners’ inquests where clinical negligence proceedings are being contemplated.

Police Law

Damian is ranked in the Legal 500 as a leading junior in Police Law (Defendant). He is instructed by a number of police forces to undertake work in the following areas:

  • Judicial review;
  • Inquests;
  • Civil actions;
  • Anti-social behaviour;
  • Sexual Harm Prevention Orders;
  • Closure Orders;
  • Cash detention and forfeiture;

Criminal Regulatory

Damian has considerable experience of prosecuting and defending in cases of regulatory crime, in particular, environmental and health and safety prosecutions. He was recently instructed by a local authority to prosecute a defendant for offences under s.33 of the Environmental Protection Act 1990. Damian drafted the indictment, settled a detailed opening note and prosecuted the matter before a jury in the Crown Court.
